Q: 2013 she just stopped showing up to court and disappeared. I want to prevent it from happening again. What can I do? Im exhuasting any resource I can so please pardon my ignorance of the law or this site.
A: David's Answer: Your do not technically have a "right to a speedy trial" in Family Court - that doctrine only applies to criminal cases. That said, you can certainly remind the Judge or Referee of her past procedural behavior & ask for the case to be expedited as swiftly as possible. You can also ask that she be monetarily sanctioned if she fails to appear without good cause. I never realized that you didn't technically have the right to a speedy trial. I could see how that would be pretty tough during a custody case.
